(a) Whoever violates Section 737.02(A) of this Chapter shall be guilty of a misdemeanor of the first degree, the penalty for which shall be a maximum fine of one thousand dollars ($1,000.00) and imprisonment for a maximum period of one hundred eighty (180) days, or both, in addition to any other penalties as imposed by this Chapter.
(b) Unless otherwise specified, whoever violates any provision of this Chapter shall be guilty of an unclassified misdemeanor and shall be fined not more than five hundred dollars ($500.00) in addition to any other penalties as imposed by this Chapter. Upon subsequent convictions, the penalty shall be an unclassified misdemeanor but the guilty party shall be fined not more than one thousand dollars ($1,000.00), in addition to any other penalties as imposed by this chapter.
