947.02 COLLECTION AND DISPOSAL DEEMED OF PUBLIC INTEREST, PURPOSE AND CONCERN.
   (a)   The system of collection and disposal of refuse by the Village from occupied residential properties authorized by this Chapter is hereby declared to be of public interest, purpose and concern. Pursuant to the Village's home rule powers under Article XVIII, Section 3 of the Ohio Constitution, the Village is establishing the following laws for the betterment of the Village, its aesthetics, its roads, and its ability to have trash collected on a more economical and timely basis.
   (b)   Mandatory Subscriptions. All Residential property owners in the Village shall subscribe to the refuse collection service of the Village's Refuse Contractor. All property owners except those specifically identified below as "Exceptions" shall become mandatory subscribers unless Certification of Exception is obtained from the Service Director.
   (c)   Mandatory Reimbursement of Village. All occupied Residential Units shall reimburse the Village the charges paid by the Village for the refuse and recycling service paid by the Village to the Village's Recycling Contractor. Said reimbursement shall be obtained by the Village charging for said service to the Residential Unit's water bill for all charges allocable to that Unit pursuant to the Village's Contract with said Contractor.
   (d)   Exceptions. All Multi-Family or Apartments, commercial, industrial, governmental and institutional establishments in the Village shall be exempt from this mandatory program. However, commercial, industrial, governmental and industrial establishments may enter into private contracts with the Village's Refuse Contractor for refuse collection, but shall not be a Subscriber under the terms of the Village's Refuse Contract.
