147.08 PENSION PICK-UP PLAN.
   (a)    For the categories of Village employees listed in subsection (e) hereof, the contribution required to be made by each such employee to the Ohio Public Employees Retirement System ("PERS") or the Ohio Police and Firemen's Disability and Pension Fund ("PFDPF"), as applicable, as an employee contribution under Ohio R.C. 145.47 and 742.31, shall be paid by the Village on behalf of the employee, in lieu of contribution by the employee in accordance with the provisions of this section.
   (b)    The gross wages payable by the Village to each such employee in any pay period shall be reduced by the amount payable by the Village to PERS or PFDPF on behalf of each such employee under subsection (a) hereof.
   (c)    The Village shall compute and remit its employer contributions to PERS or PFDPF based upon the employee's total salary. The total combined expenditures of the Village for such employees' total salaries payable under applicable Village policies and the total amount paid by the Village pursuant to the provisions of this section shall not be greater than the amount the Village would have paid had this provision not been in effect.
   (d)    The provisions of this section shall apply to all employees in the categories listed in subsection (e) hereof and no such employee shall have the option to receive direct payment of the amounts contributed by the Village to PERS or PFDPF on his or her behalf in lieu of such amounts being contributed to PERS or PFDPF, or of being excluded from such pick-up.
   (e)    This section shall apply to all Village employees in the following categories:
(1)    The Chief of Police; and
(2)    Full-time police officers, sergeants and lieutenants.
   (f)    The Village Administrator is hereby directed to take all acts necessary and appropriate to initiate implementation of the provisions of this section, including, but not limited to, making applications to the PERS Board and PFDPF Board for compliance review and approval.
   (g)    Subject to any requirements imposed by the Internal Revenue Service, the PERS Board or PFDPF Board, the provisions of this section shall apply to all payroll payments payable by the Village to such employees effective with the pay period commencing April 1, 1995, provided that the same shall be effective only so long as they are approved by the PERS Board or its agents or the PFDPF Board or its agents.
