147.01 VACATIONS.
   (a)    No employee shall be entitled to vacation pay during the calendar year in which he or she is first employed. During the year immediately following the year first employed, the new employee shall be entitled to take 80 hours of vacation, reduced on a pro-rated basis by multiplying 80 hours by the fraction determined by dividing the number of hours actually worked by the total number of regular work hours in the year first employed.
   (b)    Following the first full calendar year of work, the vacation leaves provided below shall accrue to the employee on January 1 of each year. Vacation leave shall be taken by the employee during the year in which it is earned and prior to December 31 of that year.
   (c)    No vacation leave shall be carried over into the next year.
   (d)    The following vacation benefits shall apply to all employees hired by the Village of Middlefield prior to January 1, 1989:
      (1)    An employee with at least ten years of service shall be entitled to 160 vacation hours with pay.
      (2)    An employee with at least fifteen years service shall be entitled to 200 vacation hours with pay.
   (e)    The following vacation benefits shall apply to all employees hired by the Village of Middlefield on or subsequent to January 1, 1989:
      (1)    An employee with at least one year service, but less than five years service, shall be entitled to 80 vacation hours with pay.
      (2)    An employee with at least five years service shall be entitled to 120 vacation hours with pay.
      (3)    An employee with at least ten years of service shall be entitled to 160 vacation hours with pay.
      (4)    An employee with at least twenty years of service shall be entitled to 200 vacation hours with pay.
   (f)    For purposes of this section, an employee's number of years of service shall be the number of full calendar years of service with the Village of Middlefield as of December 31 of the year immediately preceding the year in which the vacation is payable.
   (g)    Scheduling Vacations.
      (1)    No non-Police Officer vacation shall be scheduled unless prior approval is received from the Village Administrator. Where possible, vacation shall be scheduled in blocks of forty (40) or more hours.
      (2)    No Police Officer vacation shall be scheduled unless prior approval is received from the Chief of Police. Where possible, the Chief of Police shall endeavor to schedule Police Officer vacation in blocks of 36 or more hours.
      (3)    Each year, prior to December 31, the Chief of Police shall post and make available to the members of the Police Department a schedule of all shifts for the following year. Subsequent to the posting of the shifts, each full-time Police Officer shall request to take vacation on specific days and shifts.
      (4)    If a Police Officer selects a shift for vacation that is scheduled as a 12- hour shift, that vacation shall count as 12 hours of vacation, and the Police Officer shall be paid for 12 hours on that vacation day. If the shift selected is an eight-hour shift, that vacation shall count as eight hours of vacation and the Police Officer shall be paid for eight hours on that vacation day.
      (5)    In the event a Police Officer selects a shift for vacation but does not have sufficient vacation hours available to be charged for the full shift, the Police Officer shall be charged whatever remaining vacation hours he/she has accrued, and shall be paid only for those accrual hours on that vacation day.
   
   (h)   The terms and provisions of this Section shall be effective as of January 1, 2024. (Ord. 23-141. Passed 11-9-23.)
