139.09 MUTUAL AID.
   (a)   Pursuant to Section 737.041 of the Revised Code, as amended, the Council hereby authorizes the Mayor and the Chief of Police, and the officer on duty in charge of the police department, to render the services of the police department to other counties, municipal corporations, townships, park districts, multijurisdictional drug, gang or career criminal task forces, or to a governmental entity of an adjoining state, in times of emergency, whether or not the Municipality has entered into mutual aid contracts for police services with any of said political subdivisions or governmental entities. The determination of “times of emergency” shall be made only by the Mayor, Chief of Police or the officer on duty in charge of the police department, upon a call for emergency police protection services by the state or another political subdivision of the state.
   (b)   Chapter 2744 of the Ohio Revised Code, as it applies to the operation of police departments, shall apply to the Municipality and to the members of its police department when the members are rendering police services outside of the Municipality, pursuant to this section and Section 737.041 of the Revised Code.
   (c)   Personnel of the police department who render emergency services to other political subdivisions pursuant to this Ordinance shall be entitled to participate in any pension or indemnity fund established by the Municipality to the same extent as while acting within the Municipality, and shall be entitled to all rights and benefits of Chapter 4123 of the Ohio Revised Code to the same extent as while performing services within the Municipality.
   (d)   If a political subdivision requests mutual aid from the Municipality pursuant to this Section, and the requesting political subdivision specifically requests mutual aid to the provided by the Municipality’s K-9 unit, a charge of $                          per four-hour time period shall be made to that political subdivision, subject to the following restrictions:
      (1)   Said charges shall not be levied in the event that the requesting political subdivision has a K-9 Unit of its own which would be available to provide mutual aid to the Municipality in similar circumstances.
      (2)   The Mayor and/or the Village Administrator, in consultation with the Chief of Police, shall be entitled to waive all or part of the imposition of said charge in appropriate circumstances.
      (3)   Where said charge is to be levied, prior to providing the Municipality’s K-9 Unit for mutual aid services, the Chief of Police or his/her representative shall notify the requesting political subdivision of the charge.
