Council action to establish or increase any Impact Fee shall be taken only by ordinance or resolution containing findings which demonstrate the basis for calculating the fee, subject to the following:
(a) As part of the basis for the Impact Fee calculation, Council shall adopt a Utility Capital Improvements Plan.
(b) At least once every two years, the Utilities Committee shall review the Utility Capital Improvements Plan (“Plan”) and shall make recommendations to Council regarding amendments to the Plan. Upon receipt of those recommendations, Council shall either approve the existing Plan or amend the existing Plan for use during the following two years.
(c) The Village may impose Impact Fees as a condition of approval of all Industrial, Commercial and Residential Development Projects in the Village which occur after the effective date of this chapter.
(d) The amount of Impact Fee for each type of residential and commercial project in the Village shall be calculated as follows:
(1) The Utilities Committee shall estimate the gallon per day water usage for each type of residential and commercial project, either by conducting statistical analyses or by adopting standards promulgated by a recognized governmental authority.
(2) The Utilities Committee shall then determine the recommended “Impact Fee Factor” by dividing the total cost of the improvements described in the Utility Capital Improvements Plan by the number of gallons per day of increased water plant and wastewater treatment plant capacity that full implementation of the Utility Capital Improvements Plan will create.
(3) The Utilities Committee shall then determine the recommended Impact Fee for each type of project by multiplying the estimated gallon per day water usage for the project by the Impact Fee Factor.
(4) The recommendations of the Utilities Committee for estimated water usage, Impact Fee Factor and Impact Fees shall be forwarded to Council for its review and approval. The recommendations, as approved or modified by Council, shall become final upon adoption by a majority of Council.
(e) The amount of the Impact Fee for industrial projects shall be calculated as set forth in Section 913.04.
(f) If the Utility Capital Improvements Plan contemplates a required increase in the capacity of the water system in an amount that is different from the required increase in the capacity for the wastewater treatment plant, then separate Impact Fees shall be calculated for the water system and the wastewater treatment plant improvements.
