913.02 NOTICE AND HEARING.
   Prior to establishing or increasing any Impact Fee, the Village Council shall hold a public hearing, subject to the following:
   (a)   Notice of the time and place of the public hearing, including a general explanation of the matter to be considered, shall be published a minimum of ten days prior to the hearing in a newspaper of general circulation in the Village.
   (b)   At least ten days prior to the public hearing, the Village shall make available to the public information demonstrating the amount or estimated amount of the Impact Fee and a summary of the basis for the calculation of the Impact Fee amount.
   (c)   Council action to establish or increase any Impact Fee shall be taken only by ordinance or resolution. Said legislation shall contain findings which demonstrate the basis for calculating the fee. Such ordinance may be, in the discretion of the Council, adopted as an emergency measure, provided that the public hearing required in this section is held.
   (d)   Any costs incurred by the Village, including engineering and legal fees, in calculating the Impact Fees and in preparing for and conducting the public hearing may be recovered as a part of the Impact Fees which are the subject of the hearing.
