As used in this chapter, the following words, terms and phrases, and their derivations, shall have the meanings set forth below:
(a) “Utility Capital Improvement” means land or facilities for the storage, treatment or distribution of water; for the collection, treatment, reclamation or disposal of sewage; or for the collection and disposal of storm waters for flood control purposes. Utility Capital Improvement also includes design, engineering, inspection, testing, planning, legal, land acquisition, and all other costs associated with construction of a Utility Capital Improvement.
(b) “Utility Capital Improvements Plan” means the plan for utility capital improvements adopted annually by the Village Council, describing the approximate location, size, and estimated costs of Utility Capital Improvement projects and identifying the sources of funding for such projects.
(c) “Collection” means the time at which the Impact Fee is actually paid to the Village.
(d) “New Development or Development Project” means any project undertaken for the purpose of development including, without limitation, a project involving the issuance of a zoning permit for construction, reconstruction or change of use. The terms New Development and Development Project do not include a project involving the issuance of a permit to remodel, rehabilitate or improve an existing structure which does not change the density of intensity of use, or the rebuilding of a structure destroyed or damaged by an act of God.
(e) “Impact Fee” means a monetary exaction imposed by the Village pursuant to this chapter as a condition of or in connection with approval of a development project for the purpose of defraying all or some of the Village's costs for Utility Capital Improvements.
(f) “Impact Fee Account” means the account into which all Impact Fees are deposited.
(g) “Industrial Development Project” means any Development Project undertaken in an industrial zoning district.
(h) “Commercial Development Project” means any Development Project undertaken in a commercial zoning district.
(i) “Residential Development Project” means any Development Project undertaken in a residential zoning district.
