911.16 MUNICIPALITY MAY INTERRUPT SERVICE.
   (a)   The Village Administrator has the right at all times to shut off the water at the mains for a period of not more than four hours for the purpose of making repairs, extensions or other purposes.
   (b)   Any person, firm or corporation using water to feed steam boilers, etc., by direct pressure from the mains, shall provide such additional storage to enable them to continue their operation during such times of emergencies when it is necessary to shut off the water supply to make repairs, etc.
   (c)   The Village Administrator has the right, at all times, to shut off the water service at the mains to any business, commercial, industrial or residential user under the following conditions:
      (1)   Such user has connected to the Village’s water system without the knowledge or consent of the Village; or

      (2)   The use of the system by such user, in the opinion of the Village Administrator and the Director of Streets and Utilities, presents an imminent danger to the integrity, safety and/or quality of the Village’s water supply system;

      (3)    Wherever possible, the Village Administrator shall take reasonable steps to provide notice to the user prior to shutoff. However, shutoff without notice shall be permitted if, in the opinion of the Village Administrator, such notice is not practicable.
   (d)   In addition to any other remedy available, the Village Administrator has the right, at all times, to shut off water service at the mains to any business, commercial or industrial customer who is seriously delinquent in payment of fees or utility charges owed to the Village, who is in violation of any zoning, or who is committing a continuing violation of any other Village ordinance. Such shutoff shall be subject to the following:
      (1)   Prior to such shutoff, the Village Administrator or the Village Solicitor shall give written notice of the proposed shutoff to the offending customer. If, within twenty-four hours of receiving such notice, the customer does not pay the fees or charges or cease the violation to the satisfaction of the Village Administrator, then shutoff may occur without further notice.
      (2)   In the event of shutoff, water service to the offending customer shall not be resumed until the fees owing have been paid or the violation at issue has been corrected and all costs incurred by the Village have been paid.
   (e)   In addition to any other remedy available, the Village Administrator has the right, at all times, to shutoff water service at the mains to any residential customer who is seriously delinquent in payment of fees or utility charges owed to the Village, who is in violation of zoning, or who is committing a continuing violation of any other Village ordinance. Such shutoff shall be subject to the following:
      (1)   Prior to such shutoff, the Village Administrator or the Village Solicitor shall give written notice of the proposed shutoff to the offending customer. If, within thirty days of receiving such notice, the customer does not pay the fees or charges or cease the violation to the satisfaction of the Village Administrator, then shutoff may occur without further notice.
      (2)   The notice of proposed shutoff shall be provided to the person designated on Village records as responsible for payment of the water bill, and shall also be provided to the owner of the premises (if different from the responsible party) based upon the best available information available on Village records. If the Village also has records of a tenant or tenants of the premises, such notice shall be provided to said tenant(s).
      (3)   The notice required by this section shall be deemed to have been given if mailed, first class mail, postage prepaid, to the last known address of the person to whom the notice is required to be given. In the event such person resides in the Village, the Village shall also attempt to deliver such notice to any such address with the Village.
      (4)   In the event of shutoff, water service to the offending customer shall not be resumed until the fees owing have been paid or the violation at issue has been corrected and all costs incurred by the Village have been paid.

   (f)   (1)   Prior to, or post-shut-off of any residential customer, the Village Administrator is authorized to enter into written agreements with residential delinquent water/sewer customers for a resolution of delinquent sums owed to the Village by any means mutually agreeable, such as an installment payment plan, a complete settlement of the account, or other similar arrangements, which may include a compromise or waiver of a portion of the delinquency. The Village Administrator shall exercise his best judgment and discretion in reaching such agreements, taking into account the amount of the delinquency, the customer’s ability to pay, the duration of the delinquency, the history of the account, any unique or special circumstances which contributed to the delinquency (such as a death in the family, job loss or unemployment, extended illness, or abnormally high medical expenses), the availability of financial assistance to the delinquent customer from social service agencies, or any other relevant factors.
      (2)   Upon making any such agreement, the Village Administrator shall provide the Mayor and Utilities Committee a copy of the executed agreement. (Ord. 12-107. Passed 7-5-12.)
