(a) Criminal Penalties. Whoever is found to have:
(1) Failed to comply with any provisions of this chapter;
(2) Failed to comply with any regulation or rule promulgated by the Village pursuant to this chapter;
(3) Knowingly made any false statement, representation or certification in any application, record, report, plan or other document filed or required to be maintained pursuant to this chapter;
(4) Falsified, tampered with or knowingly rendered inaccurate a monitoring device or method required under this chapter;
(5) Violated an order of the Village issued pursuant to this chapter;
(6) Violated the provisions of any permit issued pursuant to this chapter or
(7) Violated any order of a Court issued pursuant to this chapter
is guilty of a misdemeanor of the first degree and shall be fined not less than one thousand dollars ($1,000) and imprisoned not more than six months. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
(b) Civil Penalties. In addition to penalties imposed pursuant to subsection (a) hereof, any discharger, Significant Industrial User, person or governmental entity who is found to have committed any of the infractions listed in subsection (a) hereof, shall be subject to the imposition of a civil penalty. Such civil penalty shall be in an amount not less than one thousand dollars ($1,000) and not to exceed twenty-five thousand dollars ($25,000) per day for each day of violation or infraction.
