(a) The Village may, for good cause shown, immediately suspend the wastewater treatment service to and the Wastewater Discharge Permit of a discharger when it appears to the Village that an actual or threatened discharge presents or threatens:
(1) An imminent or substantial danger to the health or welfare of persons;
(2) A substantial danger to the environment; or
(3) An interference with the operation of the POTW.
(b) Any discharger notified of the suspension of the Village's wastewater treatment service for the reasons set forth in subsection (a)(1) hereof, shall immediately cease all discharges. A discharger notified of the suspension of the Village's wastewater treatment service for the reasons set forth in subsections (a)(2) or (3) hereof, shall cease all discharges if so ordered after notice and an opportunity for a hearing as provided in Section 905.19(c).
(c) In the event of failure of the discharger to comply with the suspension order within the specified time, the Village shall take all actions necessary, including but not limited to judicial proceedings, to compel the discharger's compliance with such order. The discharger shall be responsible for all costs associated with said action, including attorney fees.
(d) The Village shall reinstate wastewater treatment service to the discharger upon receipt of proof of the elimination of the noncomplying discharge or conditions creating the threat of imminent or substantial danger as set forth above.
