711.02 APPLICATION FOR LICENSE; INVESTIGATION.
   (a)   In order to obtain a license to solicit, every person or organization shall fill out an application form which gives the name and address of the person or organization, the names and addresses of the persons who will be soliciting for such person or organization, the license plate numbers of any vehicles to be used and the reasons why the person or organization qualifies as a charitable, religious or benevolent organization. The representatives of such organization or person shall give proof of their identification and proof of their authority to act for the cause they represent. In addition, upon request, the applicant shall furnish to the Municipal representative proof that he has filed with the State Attorney General or the County Clerk of Courts the information required as set forth in Ohio R.C. 1716.02
 
   (b)   Upon receipt of such application, the original shall be referred to the Chief of Police, who shall investigate the applicant's background to the extent he deems necessary for the protection of the public good. In arriving at his recommendation to refuse or issue the license the Police Chief shall consider any fraud, misrepresentation or false statements contained in the application, conviction of a crime or previous soliciting or peddling in the area in an unlawful manner or in such a manner as to constitute a breach of peace or a menace or nuisance to the health, safety or general welfare of the public. If the Police Chief recommends refusal, he shall so endorse the application with his reasons set forth thereon and return the application to the Mayor, unless the Chief is processing the application himself. The applicant shall then be notified of the decision. If the Police Chief recommends approval, he shall so endorse the application, return it to the Mayor, who shall then notify the applicant.
