521.08 LITTERING AND DEPOSIT OF GARBAGE, RUBBISH, JUNK, ETC.
   (a)    No person shall place or dispose of any garbage, waste or peelings of vegetables, fruits, rubbish, ashes, cans, cartons, boxes, parts of automobiles, wagons, furniture, glass, oil, sludge or waste from settling tanks or ponds of a commercial operation or anything else of an unsightly or unsanitary nature along, near or on any public road, street, parkway, park drive, highway, ditch or any land adjoining any public road, highway or ditch within the Municipality, except on land provided by the Planning Commission or by ordinance, unless directed to do so by public officials on special clean-up days.
   (b)    Whoever transports junk, refuse or garbage in any manner over and upon any street, alley, road, parkway, park drive or public highway within the Municipality, shall do so in such manner that none of such junk, refuse or garbage shall be strewn upon and/or along such street, alley, road or public highway.
   (c)    No person shall deposit or permit to be deposited any garbage, refuse, matter, offal, animal carcasses or other matter set forth in subsection (a) hereof which may become offensive, noxious or dangerous to the public health, on his own premises, or any premises under his control, or deposit such garbage or refuse matter in any back lot, public ground, vacant lot, park, alley, street or areaway, or in any other place within the Municipality, except as is otherwise provided by law.
   (d)    No person shall deposit any junk, refuse or garbage in any receptacle or garbage dumpster within the Village unless that person owns or leases the garbage receptacle or dumpster, or is authorized to deposit the junk, refuse or garbage by the owner or lessee of the dumpster.
   (e)    No garbage pail or container shall be permitted to remain on the tree lawn for a period longer than twenty-four hours after the pickup and removal of the garbage contained therein.
   (f)    Whoever violates this section is guilty of a minor misdemeanor on a first offense; on each subsequent offense such person is guilty of a misdemeanor of the fourth degree.
