(a) The Village Administrator is hereby authorized and directed to established a separate fund which shall be known as the Drug Offenses Trust Fund. Moneys from this fund shall be used to subsidize the Police Department’s efforts that pertain to drug offenses.
(b) Whenever the Police Department is primarily responsible for or involved in making the arrest of and in prosecuting any offender who violates Ohio R.C. 2925.03, any mandatory fine imposed upon the offender pursuant to Ohio R.C. 2925.03(H) shall be paid to the Drug Offenses Trust Fund. Any additional fine imposed pursuant to Ohio R.C. 2925.03(I) shall be disbursed as otherwise provided by law.
(c) Whenever a person is charged with any violation of Ohio R.C. 2925.03 and forfeits bail posted pursuant to Ohio R.C. 2937.22 through 2937.46 or Rule 46 of the Ohio Rules of Criminal Procedure, the forfeited bail shall be paid to the Drug Offenses Trust Fund.
(d) The Police Chief is hereby authorized, pursuant to Ohio R.C. 2925.03(J)(2), to adopt a written internal control policy addressing the use and disposition of all fine moneys deposited into the Drug Offenses Trust Fund.
