§ 97.11 TREE CLEARANCES.
   (A)   The owner of any tree overhanging any right-of-way within the town shall prune the branches so that such branches:
      (1)   Shall not obstruct the light from any street lamp;
      (2)   Shall not obstruct the view of any street intersection;
      (3)   Shall not obstruct the visibility of any traffic control device or sign; and
      (4)   Allow for a clear space of eight feet above the surface of a public sidewalk and 14 feet above the surface of a street.
   (B)   The owner shall perform the pruning at the owner’s expense within 30 calendar days after receiving a written notice from the town. In the event the owner fails to comply with the notice, the town shall have the authority to perform the pruning and to charge the cost of pruning to the owner.
   (C)   Nothing contained herein shall prohibit the town from performing the pruning without notice and charging the cost thereof to the owner in the event that it is determined that an emergency exists. The Tree Board shall make such recommendations as it deems appropriate to assist the town in implementing this section.
