210.05 LOCAL PREFERENCE IN AWARDS FOR PURCHASE OF COMMODITIES AND NONPROFESSIONAL SERVICES.
   (a)   In competitive bid awards for the purchase of commodities and nonprofessional services, the City may grant a local preference to businesses located within the City. In determining the lowest and best bidder or vendor, a five percent local preference may be computed on the amount of the low bid meeting specifications by a non-City bidder or vendor. The preference may be applied up to a maximum of five percent or five thousand dollars ($5,000), whichever is less.
   (b)   When proof of situs is required, the bidder or vendor must authorize a release of information necessary to the City to establish the business location.
   (c)   Ties between one City bidder or vendor and one or more non-City bidders or vendors meeting specifications shall be broken in favor of the City bidder or vendor.
   Ties between two or more City bidders or vendors meeting specifications shall be broken through a coin toss method until the winner remains.
   (d)   The City Manager or his or her designee may promulgate rules and regulations to implement this section, provided that they are not inconsistent with the provisions of this section.
