(a) Employee Parking Permits.
(1) Parking permits may be purchased for each calendar year. The permit shall entitle the vehicle in which it is lawfully displayed to parking time in those public parking lots designated by the City Manager. Vehicles lawfully displaying these permits shall not be subject to the parking duration limitations as posted for the designated public parking lot in which the vehicle is located provided all other requirements of this section are met.
(2) The fee for an employee parking permit shall be twenty-five dollars ($25.00) per year.
(b) One-Day Permits.
(1) One-day parking permits may be purchased from the City and shall allow the vehicle, in which they are lawfully displayed, to unlimited parking on the date designated, in those public parking lots designated by the City Manager. Only one vehicle shall be authorized to use each one-day parking permit.
(2) The fee for a one-day permit shall be one dollar ($1.00) per day.
(c) Residential Parking Permits. Residential parking permits may be purchased from the City. The permit shall provide the permit holder to one reserved parking space in a public parking lot designated by the City Manager. Residential parking permits are intended for residents of downtown who rely on public parking lots for parking and shall be issued as follows:
(1) Permits shall be issued only after the submission and approval of a residential parking permit application by the applicant. The application shall be in a form prescribed by the City Manager.
(2) Permits shall only be issued to residents who reside within the boundaries of the CBD-1 (Central Service District) zoning district.
(3) Permits shall be issued to only those residents who own their residence or who are currently renting a residential unit under a lease agreement with a duration of not less than one year.
(4) Residential parking permits shall only be issued to residents of residential units that are located in a building where a sufficient number of private parking spaces cannot be provided by the owner of such building. For the purposes of this section, one parking space per residential unit is considered sufficient.
(5) Residential parking permits are limited to one such permit per residential unit.
(6) Residential parking permits shall only be used by residents of the housing unit to which the permit was issued.
(7) For each residential parking permit issued the City shall mark a parking space in a public parking lot as “reserved” and designate the space as such through the posting of a sign or similar demarcation as determined by the City Manager or their designee.
(8) Residential parking permits shall only be issued to residential units located within the CBD-1 zoning district as identified on the City of Miamisburg Official Zoning Map.
(9) There shall be no more than one parking space reserved under this section for every five spaces contained within any individual public parking lot.
(10) The fee for a residential parking permit shall be one hundred dollars ($100.00) per year.
(d) Display of Permit Required. All permits issued under this section are required to be clearly displayed in the front windshield area of the vehicle to which they are issued. It shall be the responsibility of the vehicle owner to keep the parking permit secure. Permits which are lost or stolen shall be replaced only after the submission of the required fee and/or application form.
(e) Effectiveness. Parking permits shall be in effect 24 hours a day, seven days a week with the following exceptions:
(1) Vehicles shall be moved no less than once in any 72-hour period except for those vehicles displaying a residential parking permit in which case this requirement does not apply.
(2) Permits are not valid on days when designated public parking lots are closed by the City for special events, construction activities, or similar situations requiring the closure of the public parking lot.
(3) The City Manager reserves the right to revoke, at any time, any parking permit issued under this section when the permit holder is found to be in violation of any provision of this section.
(4) In the case of residential parking permits, if it is determined that the space is no longer being used by the permit holder, the City Manager may, upon written notice to the permit holder, cause all signs and other demarcations removed from the parking space for which the permit was issued.
(f) Penalty. Any person found to be in violation of this section by parking a motorized vehicle in a designated parking space without displaying the proper permit shall be subject to Section 454.99.
