452.05 WILLFULLY LEAVING VEHICLES ON PRIVATE OR PUBLIC PROPERTY.
   (a)   No person in charge or control of any private property within the City, either as owner, tenant, occupant, lessee or otherwise, shall leave or suffer to remain on his or her property any junk motor vehicle, as defined in Section 660.07 of the General Offenses Code, whether owned by him or her or by another person, unless it is located within a totally enclosed building or garage.
   (b)   No person shall leave or suffer to remain on any public property, including a public street, right-of-way, public parking area or any other property open to the public for purposes of vehicular travel or parking, any junk motor vehicle, as defined in Section 660.07 of the General Offenses Code, for 48 hours or longer, without notification to the Chief of Police of the reasons for leaving the motor vehicle in such place.
   (c)   Lawfully approved automobile repair garages and facilities, as defined in of the Planning and Zoning Code, shall be permitted to leave or suffer to remain on their property a vehicle as described above for a period of time not to exceed 30 days.
   (d)   Lawfully approved new and used automobile sales lots shall be permitted to leave or suffer to remain on their property a vehicle that does not have a current license plate or validation sticker, provided that the new or used automobile does not meet any of the other criteria that would constitute such vehicle as a junk motor vehicle, as defined in Section 660.07 of the General Offenses Code.
   (e)   Should an owner, tenant, occupant, lessee or other person violate the provisions of this section, the Chief of Police or other designated enforcement official may serve notice on such person to remove the vehicle within seven days. After the expiration of such period, the Chief of Police or other designated enforcement official may have any such vehicle removed.
   (f)   Whoever violates any of the provisions of this section is guilty of a minor misdemeanor, and shall also be assessed any costs incurred by the Municipality in disposing of a vehicle less any money accruing to the Municipality from such disposal.
