There is hereby created and established a Parks and Recreation Advisory Commission which shall consist of eleven members as hereinafter provided. Two members shall be members of the Board of Education of the Miamisburg City School District or members appointed by such Board of Education, who shall be residents of the City of Miamisburg, and nine members shall be appointed by a majority vote of the Council. Members of the Parks and Recreation Advisory Commission shall be appointed for a term of two years each, provided that the first persons appointed pursuant to this section shall be appointed as follows: one member to be appointed by the Board of Education of the Miamisburg City School District shall be appointed for a one-year term; one member to be appointed by the Board of Education of the Miamisburg City School District shall be appointed for a two-year term; four members to be appointed by the Council shall be appointed for a one-year term; and five members to be appointed by the Council shall be appointed for a two-year term. Such members shall continue in office until a successor is appointed. All subsequent appointments shall be for a period of two years.
If the Board of Education of the Miamisburg City School District shall fail to appoint the members as hereinabove provided within sixty days after the effective date of this section, or within sixty days after any vacancy shall occur for which said Board of Education is to make the appointment, or if it is determined by any court that said Board of Education does not have the power under the laws of the State of Ohio to make such appointments, then and in those events the Council shall make the appointment of such members.
