618.03 IMPOUNDING AND DISPOSITION; RECORDS.
   (a)   A police officer or animal warden may impound every dog, cat or other animal found in violation of Section 618.02. Upon impoundment, the City Animal Control Officer or other authorized animal control officer may deliver such dog, cat or other animal to the county animal shelter where it will be held for a minimum of 72 hours, during which time the owner may redeem such dog, cat or other animal at the County Animal Shelter by paying those fees established by the county and by obtaining, if necessary, a valid registration tag. After the minimum 72-hour holding period, such animal may be sold or otherwise disposed of at the animal shelter as provided by Ohio R.C. 955.16. The City Manager is authorized to enact agreements with the county animal shelter necessary in the enforcement of this division.
   (b)   A record of all dogs, cats or other animals impounded, the disposition of the same, the owner's name and address, if known, and a statement of any costs or receipts involving such dog, cat or other animal shall be kept.
   (c)   Wild animals are the property of the State of Ohio and may be disposed of at the discretion of the county animal shelter. The City Animal Control Officer or other authorized animal control officer shall inform the affected property owner of the outcome of a wild animal removal.
   (d)   The City Manager is authorized to enact agreements with the Montgomery County Animal Resource Center or other parties necessary for the enforcement of this section. On the execution of a certain agreement by the City of Miamisburg and the Montgomery County Animal Resource Center or other party the Animal Warden authorized under the terms of such agreement is authorized to impound any stray animal, cat or dog found in violation of this chapter or Ohio R.C. 955.21 and 955.22, and to issue citations for the purpose of giving notice to the owners of the animals as provided in this chapter.
