1222.06 DEPOSITS TO THE ROADWAY IMPROVEMENT FUND.
   If, in the opinion of the City Engineer, certain improvements such as road widenings, curbs and sidewalks, storm sewers and related items required by planned unit development ordinances, these Subdivision Regulations and other regulations and laws governing the same, are not necessary to be constructed at the time the property is being developed, a cash deposit shall be made to the Roadway Improvement Fund in an amount equal to an amount submitted by a certified professional engineer and approved by the City Engineer. By accepting the cash deposit in lieu of the physical improvements, the City shall hold the property owner and subsequent owners of the affected parcel(s) harmless for the initial cost of installation of the improvements. The City shall utilize the funds deposited into this account for the purpose of designing, planning, engineering and constructing roadways, road widenings, curbs, sidewalks, storm sewers and other related items, but the funds shall not be used for maintenance purposes.
