As used in these Subdivision Regulations:
(a) Building Setback Line. "Building setback line" means the line indicating the minimum horizontal distance between the street right-of-way line and the front line of a building.
(b) Commission. "Commission" means the City Planning Commission of the City of Miamisburg.
(c) Cul-de-sac. "Cul-de-sac" means a short minor street which is terminated by a circular or T-shaped turnaround or background.
(d) Easement. "Easement" means a grant, by a property owner, of the use, for a specific purpose, of a strip or parcel of land, to the general public, a corporation or a certain person.
(e) Freeway. "Freeway" means a strip of public land devoted to the movement of traffic, over which the abutting property owners have no right of access, light or air.
(f) Local Minor Street. "Local minor street" means any street of local importance that is not shown as being a part of the Master Thoroughfare Plan.
(g) Protective Covenant. "Protective covenant" means a restriction on the use of all private property within a subdivision, to be set forth on the plat, for the benefit of all the lot owners.
(h) Right of Way. "Right of way" means the width between property lines of a road, street, alley or parkway.
(i) Subdivision. "Subdivision" means the division of any parcel of land, including frontage along an existing street or highway, into two or more lots or other divisions of land for the purpose of immediate or future sale, transfer of ownership or building development, including all changes in street or lot lines, or the replatting or resubdivision of land heretofore divided or platted into lots, tracts or parcels, provided, however, that divisions of land for agricultural purposes, in parcels of more than ten acres, not involving new streets or easements of access, shall be exempted.
(j) Subdivision Regulations. "Subdivision Regulations" means the provisions of Ordinance 1139, passed June 21, 1960, as amended, which are codified herein as Title Four of this Planning and Zoning Code.
(k) Thoroughfare. "Thoroughfare" means a street or highway of considerable continuity as indicated on the Master Thoroughfare Plan.
