(a) The City may charge the owner or assess the property, or both, for the cost of collecting and disposing of waste from property located within the City. The monthly fees for refuse and recycling service are established as follows:
(1) Year 1 - $14.00 per month (effective January 1, 2023).
(2) Year 2 - $16.00 per month (effective January 1, 2024).
(b) The fee is for the weekly collection and disposal of waste in containers approved by the City. Each residence and business serviced by the City shall have its own waste container or containers. For purposes of this section, a “residence” is each unit in an apartment or housing complex and each part of a house or residential structure providing separate living quarters including a bath, kitchen and sleeping room for an individual or group of individuals, related or otherwise. The fee is also for the annual pick-up of large items, the annual leaf collection program and for the recyclables collection service.
(c) The City shall include the fee on the property owner's utility bill or as a separate bill, and the property owner shall pay the fee in the manner and amount specified on the bill. A property owner may, by agreement, require a tenant or lawful occupant of the property to pay the City the fee, however, in the event of nonpayment by a tenant, the property owner remains responsible for paying the fee.
(d) All fees for refuse collection are due and payable upon receipt. If the bill is not paid on or before the fifteenth day after mailing such notice, a penalty of 5% shall be posted to the account. If the account is not paid within 45 days after mailing such notice, the service may be discontinued by the City, and the householder or any other person, firm or corporation receiving said service but failing to pay therefor, may be duly prosecuted as provided in Section 1060.99. Alternatively, the Finance Director may certify such charges to the County Auditor, who shall place the same on the tax duplicate and collect the charges thereon and penalties therefor in the same manner as other taxes are collected.
(e) In the event a property owner's utility bill contains charges for multiple utility services, and the property owner makes a partial payment of the total amount due, the amount paid by the property owner shall first be applied to any outstanding fee owed for refuse collection and disposal. Any other amount paid shall be applied to remaining fees as set forth in Sections 1042.01 and 1042.08 of this Code of Ordinances.
