When it is determined by the City Manager that it is necessary to remove an encroachment to further the construction of an improvement and to promote the safety, health and welfare of the City, the City Manager may direct that such encroachment be removed by serving registered notice upon the owner of the land where the encroachment exists to remove the same within thirty days from receipt of such notice. No person shall fail to comply with such notice within such period.
