SECTION 15.806.  ACTION BY THE ZONING, PLANNING AND APPEALS COMMISSION.
   A.   In those instances when the Zoning, Planning and Appeals Commission is to hear and decide matters as may be referred to it by the President and Board of Trustees or committed to it by ordinance, the Zoning, Planning and Appeals Commission shall, within forty-five (45) days after the final session of the hearing decide upon the granting or denial of the relief sought. If, at the expiration of such forty-five (45) days, the Zoning, Planning and Appeals Commission does not make its decision, it shall be concluded that the Zoning, Planning and Appeals Commission made negative findings and denied the relief for which application was made.
   B.   In those instances when the Zoning, Planning and Appeals Commission is to hear and make a recommendation to the President and Board of Trustees, the Zoning, Planning and Appeals Commission shall, within forty-five (45) days after the final session of the hearing, recommend the granting or denial of the relief sought, unless within such period of time the Zoning, Planning and Appeals Commission shall make request to and receive permission from the Village Board for an additional forty-five (45) days in which to make its recommendation. If, at the expiration of such forty-five (45) day period or additional forty-five (45) day period, as the case may be, the Zoning, Planning and Appeals Commission does not make its recommendation, it shall be concluded that the Zoning, Planning and Appeals Commission made negative findings and recommended denial of the relief for which application was made.
      1.   Whenever a variation is to be made by ordinance, upon receiving the report containing the recommendation of the Zoning, Planning and Appeals Commission, without further public hearing, the President and Board of Trustees may grant or deny any proposed variation or may return it to the Zoning, Planning and Appeals Commission for further consideration.
      2.   Any proposed variation to be made by ordinance which fails to receive a favorable recommendation of the Zoning, Planning and Appeals Commission shall not be granted except by the favorable vote of two-thirds (2/3) of all of the Village Board.
