SECTION 9.1302.  AMENDMENTS.
   The International Property Maintenance Code, International Code Council 2012 Edition, adopted in Section 9.1301 of this Building Code, is amended hereby in the following respects:
   A.   The name "Village of Mettawa" is inserted wherever reference is made to jurisdiction and enforcement, and/or reference is made to the "Authority having jurisdiction."
   B.   Subsection 102.3 "Application of other codes" is amended so that hereafter Subsection 102.3 shall be and read as follows:
      "102.3 Application of other codes. Repairs, additions or alterations to a structure, or changes to occupancy, shall be done in accordance with the applicable procedures and provisions of the Municipal Code of the Village of Mettawa of 2001, as amended."
   C.   Subsection 102.7 "Referenced codes and standards" is amended so that hereafter Subsection 102.7 shall be and read as follows:
      "102.7 Referenced codes and standards. The codes and standards referenced in this International Property Maintenance Code shall be those that are listed in Chapter 8 and those that are in compliance with the Municipal Code of the Village of Mettawa of 2001, as amended, and considered part of the requirements of this International Property Maintenance Code to the prescribed extent of each such reference. Where differences occur between provision of this International Property Maintenance Code and the referenced standards, the provisions of this International Property Maintenance Code shall apply."
   D.   Subsection 103.5 "Fees" is amended to hereafter be and read as follows:
      "103.5 Fees. The fees for activities and services performed by the department in carrying out its responsibilities under this International Property Maintenance Code shall be as indicated in resolutions and/or ordinances adopted from time to time by the President and Board of Trustees."
   E.   Subsection 110.1 "General" is amended to hereafter be and read as follows:
      "110.1 General. The code official shall order the owner of any premises upon which is located any structure, which in the code official's judgment is so old, dilapidated or has become so out of repair as to be dangerous, unsafe, unsanitary or otherwise unfit for human habitation or occupancy, to repair and make safe and sanitary for human habitation or to raze and remove at the owner's option; or where there has been a cessation of normal construction of any structure for a period of more than sixty days, to complete such construction or raze and remove such structure. In the order, the code official shall set a time within which said demolition, repair or completion of construction shall take place."
   F.   Subsection 110.2 "Notices and orders" is amended to hereafter be and read as follows:
      "110.2 Notices and orders. All notices and orders shall comply with Section 107."
   G.   Subsection 110.3 "Failure to comply", is amended to hereafter be and read as follows:
      "110.3 Failure to comply.  If the owner of a premises fails to comply with the order called for in subsection 110.1, the code official shall apply to the circuit court for an order directing the owner to demolish the structure or in the alternative allowing the Village of Mettawa to demolish the structure and tax the costs of said demolition against the owner."
   H.   Subsection 110.4 "Salvage materials", is amended to hereafter be and read as follows:
      "110.4 Salvage materials. When any structure has been ordered razed and removed, the governing body or other designated officer under said contract or arrangement aforesaid shall have the right to sell the salvage and valuable materials at the highest price obtainable. The net proceeds of such sale, after deducting the expenses of such razing and removal, shall be promptly remitted with a report of such sale or transaction, including the items of expense and the amounts deducted, for the Person who is entitled thereto, subject to any order of a court. If such a surplus does not remain to be turned over, the report shall so state."
   I.   Subsection 302.4 "Weeds", is amended to hereafter be and read as follows:
      "Reserved"
   J.   Without affecting sub-subsections 404.4.2 through 404.4.5, subsection 404.4 "Bedroom and living room requirements" and sub-subsection 404.4.1 "Room area", are amended to hereafter be and read as follows:
      "404.4 Bedroom requirements. Every bedroom shall comply with the requirements of sub-subsections 404.4.1 through 404.4.5.
      404.4.1 Area for sleeping purposes. Every bedroom occupied by one person shall contain at least 70 square feet (6.5m2) of floor area, and every bedroom occupied by more than one person shall contain at least 50 square feet (4.6m2) of floor area for each occupant thereof."
   K.   Subsection 404.5 "Overcrowding" is amended in its entirety to hereafter be and read as follows:
      "404.5 Overcrowding. Dwelling units shall not be occupied by more occupants than permitted by the minimum area requirements of Table 404.5:

      404.5.1 Sleeping area. The minimum occupancy area required by Table 404.5 shall not be included as a sleeping area in determining the minimum occupancy area for sleeping purposes. All sleeping areas shall comply with subsection 404.4.
      404.5.2 Combined spaces. Combined living room and dining room spaces shall comply with the requirements of table 404.5 if the total area is equal to that required for separate rooms and if the space is located so as to function as a combination living room/dining room."
   K.   Chapter 5 "PLUMBING FACILITIES AND FIXTURE REQUIREMENTS" is deleted, except for subsections 501.2, 502.1, 504.1, 505.1, 505.4, 506.1, 506.2 and 507.1.
   L.   Chapter 6 "MECHANICAL AND ELECTRICAL REQUIREMENTS" is deleted, except for subsections 601.2, 602.1, 602.2, 603.1 and 603.4; all of section 604, all of section 605 and subsection 606.2.
   M.   Chapter 8 "REFERENCED STANDARDS" is amended to add reference to and the title: "Municipal Code of the Village of Mettawa of 2001, as amended."
