SECTION 1.601.  VILLAGE ADMINISTRATOR.
   A.   Position Established; Appointment; Removal. There is created hereby the position of Village Administrator. The Village Administrator, whether a person, firm or corporation, shall be appointed by the Village President, by and with the advice and consent of the President and Board of Trustees. The Village Administrator shall be responsible to the Village President and to the President and Board of Trustees for the management and operation of all of the administrative affairs of the Village, need not reside within the corporate limits of the Village and shall receive such compensation as may be fixed by contract from time to time. The Village Administrator shall have direct communication with the President and Board of Trustees and its members individually as well as with all of the other Village officials.
      1.   The nominee for the position of Village Administrator shall be considered by the President and Board of Trustees solely on the basis of executive and administrative qualifications; with special reference to education and experience with respect to the duties of the position herein set forth, which require technical training.
      2.   No Village Trustee or Village President shall be appointed to the position of Village Administrator during the term for which he or she has been elected nor within one year after the expiration thereof.
      3.   The Village Administrator may be removed from office by the Village President on any written charge, whenever the Village President is of the opinion that the interests of the Village demand removal.
         a.   The Village President shall report the reasons for the removal to the President and Board of Trustees at a meeting to be held not less than five (5) nor more than ten (10) days after the removal.
         b.   If the Village President fails or refuses to place the item of "Consideration of the Report of Removal" upon the agenda of such meeting of the President and Board of Trustees and state the reasons for the removal in such report, or if the President and Board of Trustees by a two-thirds vote of all of the President and Board of Trustees authorized by law to be elected disapprove of the removal at such meeting, the Village Administrator thereupon shall be restored to office. The vote shall be by yeas and nays, which shall be entered into the Minutes of the meeting of the President and Board of Trustees. Upon restoration, the Village Administrator shall give a new bond and take a new oath of office. The Village Administrator may not be removed a second time for the same offense.
   B.   Duties. The Village Administrator shall:
      1.   Have the management and control of all matters and things pertaining to the operation and maintenance of the properties of the Village;
      2.   Assist the Budget Officer by undertaking all of the work of the Budget Officer as set forth in Article IV of Chapter 2 of this Municipal Code;
      3.   Be the Village purchasing agent and purchase all materials, supplies or equipment for which funds are provided in the budget, and for that purpose the Village Administrator is authorized to make expenditures of Ten Thousand Dollars ($10,000) or less without preliminary authorization by the President and Board of Trustees; receive bids for purchases or contracts for any purpose, including but not limited to those affecting the operation and maintenance of Village services; and advise the President and Board of Trustees on the advantages or disadvantages of the contract or merchandise on which such bids have been received - with the understanding that the Village Administrator shall have no authority to enter into contracts for services and/or the performance of public works and that all expenditures and payments, regardless of amount, shall be subject to the confirmation or approval of the President and Board of Trustees and to the limitations imposed by the adopted budget - provided, however, that in times of emergency the Village Administrator is authorized to contract for services of not more than Ten Thousand Dollars ($10,000) without preliminary authorization of the President and Board of Trustees;
      4.   Attend all meetings of the President and Board of Trustees, unless excused therefrom by the President and Board of Trustees and except when the Village Administrator's removal is under consideration by the Board;
      5.   Have the privilege of taking part in the discussion of all matters coming before the President and Board of Trustees and shall be entitled to notice of all meetings, regular and special, of the President and Board of Trustees and all of the Village commissions and other boards, and committees of all of the foregoing;
      6.   Recommend to the President and Board of Trustees for adoption such measures as the Village Administrator may deem necessary or expedient;
      7.   Perform the duties and have the powers as are fixed and conferred upon the Village Administrator from time to time by the President and Board of Trustees, whether by ordinance, resolution or motion;
      8.   Serve ex officio in the position of Deputy Village Clerk and, in the temporary absence of the Village Clerk in case of illness or otherwise, perform all of the duties of the Village Clerk; and
      9.   Give a monthly report to the President and Board of Trustees and, in addition, information concerning the fiscal matters of the Village as, from time to time, may be required by the President and Board of Trustees; and in connection with the latter, have supervision over the accounting work of the Village.
As used in this Subsection EMERGENCY means: An unforeseen combination of circumstances or the resulting state that calls for immediate action or an unforeseen circumstance that arises following a Village Board meeting requiring action prior to the next Village Board meeting.
