§ 132.003 EASEMENT FEE POLICY.
   (A)   The Commuter Rail Board (“Board”) hereby establishes the following municipal easement fee policy.
      (1)   Metra shall charge municipalities and other governmental entities a one-time fee for each municipal utility occupation to reimburse Metra for administrative costs and expenses (“administrative fee”). The initial administrative fee shall be $2,500.
      (2)   Metra annual and lump-sum easement fees shall be waived for municipal or governmental utility occupations of the Division’s property where the municipality or governmental entity receives no economic gain (“municipal utility occupation”).
      (3)   In the future, municipalities and governmental entities shall not be charged annual easement fees for existing municipal utility occupations on Metra property.
      (4)   The administrative fee shall be periodically escalated based on increases in the consumer price index for all urban consumers (“CPI-U”) but not more often than annually.
   (B)   This policy shall not apply to profit-based utility companies or other quasi-public or non-governmental entities.
   (C)   The Executive Director is hereby authorized, empowered and directed on behalf of the Board to take such action as is necessary or appropriate to implement, administer and enforce this section, including, without limitation, adjustment or waiver of the administrative fee in appropriate circumstances, as determined by the Executive Director or the Executive Director’s designee, subject to the limitations set forth in Metra’s bidding regulations in Chapters 90 and 91 and the Assistant Secretary, if required, is hereby authorized, empowered and directed on behalf of the Board to attest such documents.
