(A) If normal fare revenue (exclusive of plan revenues) is lower than budgeted in any year for which a plan is in effect and such shortfall would result in a Service Board failing to attain its required recovery ratio, then the Service Board must amend its budget to meet the required recovery ratio, but may not use or withdraw funds that would otherwise be deposited into the plan without amendment of that Service Board’s budget by vote of the RTA Board.
(B) Each plan shall include the provisions of this section.
