The Commuter Rail Division (“Metra”) hereby approves the proposal for excess liability insurance coverage, as recommended by the plan’s Fund Advisors and Fund Manager, and authorizes the Fund Manager and Advisors to take all actions which they deem necessary or proper to enter into an agreement and contract for such insurance coverage, and further to arrange for the withdrawal of amounts from the Fund for the purchase of such insurance including, upon the future concurrence of the Fund Manager and Advisors, any optional reinstatement premiums permitted under the insurance agreement.
