(A) The Board of Directors of the Commuter Rail Division hereby adopts the State UCP developed by the Commuter Rail Division and the other state participants, and agrees to all modifications of said UCP as required by DOT and/or the Federal Transit Administration.
(B) The memorandum of understanding and procedures, in forms substantially similar to the attached copies, are hereby approved.
(C) The Chairperson of the Commuter Rail Division and, at the Chairperson’s designation, the Executive Director of the Commuter Rail Division are hereby authorized and directed on behalf of the Commuter Rail Division to execute and deliver said memorandum of understanding and procedures, and all subsequent amendments thereto, and the Assistant Secretary is hereby authorized and directed on behalf of the Commuter Rail Division to attest said memorandum of understanding and procedures and all subsequent amendments thereto, and the Assistant Secretary is hereby authorized and directed on behalf of the Commuter Rail Division to attest said memorandum of understanding and procedures, and all subsequent amendments thereto.
(D) The Chairperson of the Commuter Rail Division and, at the Chairperson’s designation, the Executive Director of the Commuter Rail Division are hereby authorized and directed to take such action as they deem necessary or appropriate to implement, administer and enforce said memorandum of understanding and procedures, and all subsequent amendments thereto.
