§ 50.021 IMPLEMENTATION OF THIS DBE PROGRAM.
   (A)   The duties and responsibilities of the DBE office and other personnel have been delineated elsewhere in this program. The activities assigned to them must be carried out to ensure this program’s success.
   (B)   The duties and responsibilities of sub-recipients are clearly spelled out in the regulations covering participation by Disadvantaged Business Enterprise in Department of Transportation programs (49 C.F.R. part 26). The CRD’s DBE office shall assume the responsibility for monitoring the activities of such sub-recipients who do not report directly to an element of the Department of Transportation. Failure of such sub-recipients to comply with the regulations may result in the denial by the Department of Transportation of further federal funds assistance.
   (C)   Certification of DBEs shall be accomplished by form attesting to the legitimacy of minority or female owned status. In the event a firm claims to hold such certification through another element of the Department of Transportation or agency requiring such certification whose requirements meet or exceed CRD’s standards, the CRD shall require acceptable information corroborating that claim.
   (D)   The overall goals established in this program have been derived through the process of forecasting probable expenditures for construction, professional and other services, and consumable supplies and the likelihood of minority and female owned businesses responding to bid solicitations. Additionally, the goals reflect our historical minority participation in both federal and non-federal assisted purchases made in the preceding year.
   (E)   Further, the goal figure also reflects what is expected to be derived from contract-specific DBE participation. While, for the most part, contract-specific goals will be utilized primarily in construction awards and architectural and engineering awards, the CRD fully intends to employ it in every contract solicitation that has sub-contracting possibilities.
   (G)   Solicitations mandating DBE subcontracting or joint ventures shall clearly state that a bidder/proposer who does not (without documented and acceptable reasons therefor) meet such goals shall be considered non-responsive, in accordance with 49 C.F.R. part 26.
