§ 50.006 DEFINITIONS.
   (A)   The Department of Transportation has promulgated the following definitions of Minority and Minority Business Enterprise (or DBE), which the CRD hereby adopts with respect to its DBE program:
      DBE. African Americans, Hispanics, Native Americans, Asian-Pacific and Sub-Continent Asian Americans and women.
      MINORITY.
         (a)   A person who is a citizen or lawful permanent resident of the United States and who is:
            1.   Black (a person having origins in any of the black racial groups of Africa);
            2.   Hispanic (a person of Mexican, Puerto Rican, Cuban, Central or South American or other Spanish culture or origin, regardless of race);
            3.   Asian American (a person having origins in any of the original peoples of the Far East, Southeast Asia, the Indian subcontinent or the Pacific Islands - excluded are Burmese and Thais);
            4.   American Indian or Alaskan Native (a person having origins in any of the original peoples of North America); or
            5.   Members of other groups, or other individuals, found to be economically and socially disadvantaged by the Small Business Administration under § 8(d) of the Small Business Act, being 15 U.S.C. § 637, as amended.
         (b)   This program also addresses businesses owned and controlled by females, regardless of race.
         (c)   Additionally, the Department of Transportation substitutes the term “socially and economically disadvantaged business” to describe these firms (49 C.F.R. part 26).
         (d)   Minority or female owned and controlled businesses eligible to participate in this program must meet the criteria for small business concerns as set forth in § 3 of the Small Business Act, being 15 U.S.C. § 632, and implementing regulations.
      OWNED AND CONTROLLED. A business:
         (a)   Which is at least 51% owned by one or more minorities or women; and
         (b)   Whose management and daily business operations are controlled by one or more such individuals.
   (B)   Any firm classified as socially and economically disadvantaged may have its status challenged by a third party. (See § 50.009.)
