§ 50.002 ORDINANCE.
   (A)   Whereas, the Department of Transportation, Urban Mass Transportation Administration has published 49 C.F.R. part 26 entitled “Participation by Minority Business Enterprise in Department of Transportation Programs” to require and increase the participation of businesses owned and controlled by minorities and economically and socially disadvantaged individuals including women in contracts and projects funded by the Department of Transportation, and has developed specific requirements for grant recipients and contractors.
   (B)   Whereas, the Commuter Rail Division of the Regional Transportation Authority is a grantee of the Department of Transportation which is firmly committed to a policy of non-discrimination in the conduct of its business including the procurement of goods and services, and desires to provide for maximum utilization of Disadvantaged Business Enterprises in CRD programs, and is further firmly committed to fulfilling its responsibilities under Executive Order 11625 of October 13, 1971, appearing at 36 FR 19967, 3 C.F.R. §§ 1971-1975 Comp., p. 616, and the Civil Rights Act of 1964, being 42 U.S.C. §§ 2000d et seq.
   (C)   Now, therefore, be it ordained that the Board of Directors of the Commuter Rail Division of the Regional Transportation Authority hereby approves and adopts a Disadvantaged Business Enterprise policy/program as revised (September 1984) for the Commuter Rail Division as attached to this chapter.
