§ 33.138 COMMITTEE’S ADMINISTRATIVE POWER.
   The Committee shall have the following powers, authorities and responsibilities within the limits provided herein:
   (A)   Construction. To determine all questions concerning the construction and interpretation of the plan and in its administration, including, but not by way of limitation, the determination of:
      (1)   The rights of employees and participants and their beneficiaries; and
      (2)   The amount of their respective benefits.
   (B)   Rules. To prescribe procedures to be followed by participants or beneficiaries filing applications for benefits, authorizations and designations under the plan, and to adopt such rules and regulations as it may deem reasonably necessary for the proper and efficient administration of the plan which are consistent with its purposes;
   (C)   Enforcement. To enforce the plan in accordance with its terms and with the Committee’s own rules and regulations;
   (D)   Information. To receive from the employer and from participants and beneficiaries such information as shall be necessary for the proper administration of the plan and to prepare and distribute, in such manner as the Committee determines to be appropriate, information explaining the plan;
   (E)   Records. To direct the Trustees with respect to the maturity of benefits, the identify of distributees and all matters involving distributions from the fund and to maintain account records of all participants and beneficiaries;
   (F)   Agents. To create subcommittees and appoint agents, and to delegate such of its rights, powers and discretions to such subcommittees or agents as it deems desirable; and
   (G)   Additional powers. To do all other acts in its judgment necessary or desirable for the proper and advantageous administration of the plan.
