§ 32.004 AGREEMENT.

 

THE NORTHEAST ILLINOIS RAILROAD CORPORATION RETIREMENT SAVINGS TRUST   This agreement made as of                                             , 1986, by and between the Northeast Illinois Regional Commuter Railroad Corporation (“NIRC”) on behalf of itself and its participating affiliates (hereinafter referred to collectively as the “Employer”) and                                                          ,                                                         ,                                                         ,                                                          and                                                          and (the “Trustees”).   WITNESSETH:   WHEREAS, NIRC plans to adopt a retirement program known as the Northeast Illinois Railroad Corporation Retirement Savings Plan (the “Plan”) to enable eligible employees to accumulate funds and share in the profits of the Employer, and thereby to provide for their future security;   WHEREAS, pursuant to the provisions of the Plan, a committee (the “Committee”) may administer the Plan; and   WHEREAS, NIRC now desires to establish this Trust as the funding medium for the Plan to hold the assets from time to time comprising the assets of the Plan;   NOW, THEREFORE, NIRC and the Trustees hereby establish this Trust so that effective as of the date the Plan becomes effective, it shall provide as follows:
