509.08 CURFEW.
   (a)   Curfew for Persons Under the Age of 18. It shall be unlawful for any person under the age of 18 to loiter, idle, wander, stroll, play, or be in a motor vehicle in, upon, or about the public streets, sidewalks, parks, public buildings and grounds and public places of amusement and entertainment, or other unsupervised places in the Village between the hours and for the respective ages as set forth below, unless accompanied by a parent, guardian, or some person over the age of 18 years having the care and custody of said person to wit:
      (1)   Under 16 years from 10:00 p.m. to 6:00 a.m. and
      (2)   Between 16 years and 18 years from 11:00 p.m. to 6:00 a.m.
   (b)   Responsibilities of Parent or Guardian. No parent or guardian having the care and custody of any person under 18 years of age shall knowingly permit such person to violate the curfew of this section or neglect to restrain or prevent such person from violating the curfew of this section.
   (c)   Exceptions.
      (1)   It shall not be a violation of this section if any person subject to the curfew of this section is upon an emergency errand or legitimate business directed by such person’s parent, guardian, or other adult person over the age of 18 years having the care and custody of such person.
      (2)   Any person under 18 years of age attending any school or church, lodge or meeting or entertainment in which the entertainment shall require person to be out at a later hour than that called for in this section shall be required to be off the public streets, alleys, or highways, one hour after said function has ended.
   (d)   Penalties.  
      (1)   Any person under the age of 18 years who violates the provisions of this section shall be apprehended and charged as being an unruly child and taken before the Juvenile Court in Fulton County, Ohio, as provided in the laws in the State of Ohio.
      (2)   Any minor so apprehended may be detained in the juvenile detention facility in the Fulton County jail overnight pending appearance before the Juvenile Court of Fulton County, Ohio.
      (3)   Every reasonable effort shall be made to contact a parent, a guardian, or other adult to whom any minor so apprehended shall be released in lieu of being detained overnight, as stated above.
      (4)   Any parent who knowingly permits such person to violate any of the provisions or neglects to restrain or prevent such child from violating any of the provisions shall be guilty of a minor misdemeanor.
