(a) Applications. All applications for park lease for organized gatherings, organized competitions or other organized legal activities for the park premises must be submitted to the Village Office. Approval of the Application must be by a majority vote of Council. Council reserves the right to reject any application.
(b) Fees and Deposits. The following fee and deposit shall be paid to the Village Fiscal Officer at least thirty (30) days prior to the lease dates;
(1) Lease fee. A lease fee of two hundred dollars ($200.00) per day shall be paid for the use of the park; and
(2) Deposit. A deposit for clean-up and damages shall be five hundred and 00/100ths dollars ($500.00). Said deposit shall be refunded in full if the park is satisfactorily cleaned up within twenty-four (24) hours after the end of the lease period, all Park Rules and Regulations have been complied with, and there is no damage to the park premises and improvements. In the event the park Rules and Regulations have been violated, the Village may retain the entire deposit or so much of it as the Council, in its sole discretion, deems appropriate as to suitable penalty for such violation. In the event of failure to satisfactorily clean up the park or its improvements, the Council may have the park cleaned and/or damages repaired and deduct the cost thereof from deposit. In the event the cost of clean-up and/or damage repair exceeds the deposit, the sponsor shall be liable and responsible for payment of the deficiency.
(c) (1) Liability of Village. Village of Metamora shall not be liable or responsible for any damage to property, injury to persons, or lost or stolen property, and sponsor shall hold Village harmless from all such losses and liability incurred during the lease period.
(2) A general liability insurance policy in the minimum amount of one million dollars ($1,000,000) shall be secured by the sponsoring organization, with the Village of Metamora named as an additional insured. The policy shall be submitted to the Village Fiscal Officer no later than thirty (30) days prior to the lease period, and, upon approval, will be held by the Village Fiscal Officer. Failure to comply with the insurance requirements automatically cancels the lease agreement.
(d) Park Equipment and Facilities. The sponsoring organization shall have access to Village Park equipment and facilities for the duration of the lease. The sponsoring organization shall be responsible for the care of such equipment, including, but not limited to, refilling gas tanks, securing equipment overnight and stocking restrooms. All necessary supplies (gas, toilet paper, paper towels, etc.) shall be provided by The Village.
(e) Food and Beverages. The sponsor, its agents and employees may sell food and beverages in the park during the lease period. Sponsor shall secure the necessary food and beverage permits from the Health Department of the State of Ohio. The permit shall be submitted to the Village Fiscal Officer no later than thirty (30) days prior to the lease period and, upon approval, will be held by the Village Fiscal Officer. If ALCOHOL is intended to be sold during
the lease:
(1) A liquor liability insurance policy in the minimum amount of one million dollars ($1,000,000) shall be secured by the sponsoring organization, with the Village of Metamora named as an additional insured. The policy shall be submitted to the Village Fiscal Officer no later than thirty (30) days prior to the lease period and, upon approval, will be held by the Village Fiscal Officer. Failure to comply with the insurance requirements automatically cancels the lease agreement.
(2) Sponsor shall secure the necessary permits from the Ohio Department of Liquor Control and shall properly comply with the laws of the State of Ohio and Regulations of the Ohio Department of Liquor Control. A copy of the permit must be submitted to the Village Fiscal Officer no later than thirty (30) days prior to the lease period.
(3) Sponsor shall be solely responsible for policing the consumption of beer and actions of the person in attendance and participating team members. Consumption of beer outside the designated areas is strictly prohibited. Beer not purchased from the sponsoring organization is prohibited in all areas of the park.
(f) Hours. The parks shall be closed at 12:00 midnight. No activities shall commence prior to 12:00 noon on Sunday.
(g) Lease. The Village of Metamora and the sponsoring organization shall enter into a written lease for use of the park. In the event the function is not held due to weather, or through no fault of the sponsoring organization, the lease fee and deposit shall be refunded, or the event rescheduled.
(h) Failure to comply with any park Rules may cancel the event/Lease at any time. Park Rules are subject to change with reasonable notice.
