5-1-15-3: COMMISSION OF BATTERY DOMESTIC VIOLENCE IN THE PRESENCE OF A CHILD:
   A.   A person commits battery domestic violence in the presence of a child if the person:
      1.   Commits a battery against a current or former spouse, a present spouse of a former spouse, a former spouse of a present spouse, parents, a foster parent, a child, a person otherwise related by blood or marriage, a person with whom the defendant is or was in a dating relationship as defined in Nevada Revised Statutes 33.018, which is consistent with Nevada Revised Statutes 200.485 while in the presence of a child is guilty of a misdemeanor and shall be punished by imprisonment of not less than thirty (30) days but not more than six (6) months and by a fine not exceeding one thousand dollars ($1,000.00).
