SECTION 3.12 Vacancies
   In the case of death, resignation or removal of a Councilperson, the vacancy shall be filled by temporary appointment as provided in this section until a successor is elected and qualified. Such successor shall be elected to the office for the unexpired term on the first Tuesday after the first Monday in November that occurs more than one hundred ten (110) days after the vacancy has occurred, except when the unexpired term ends within one (1) year immediately following the date of such election. When the unexpired term ends in the same year as the election would normally take place, no separate election for the unexpired term will be held, but the councilperson or councilpersons elected at the regular municipal election shall, in addition, be considered the elected successor to the temporary appointee or appointees and shall assume the office immediately upon certification of election. Except for the date of the election of a successor as provided for in this section, the power of Article VIII of the Charter shall be complied with.
   The temporary appointee shall be chosen by a majority vote of the remaining members of Council, except that if a choice by vote of Council not be made within thirty (30) days of the vacancy occurring, the President of Council shall choose the temporary appointee. (Amended 11-6-79; 11-5-19)
