735.08 CLASS II WELLS.
   Class II wells shall comply with the following requirements:
   (a)    Class II wells drilled after February 15, 1983 shall be located a minimum of 300 feet from any structure unless waived by the Planning Commission due to a hardship, but under no circumstances shall it be less than 100 feet. Class II wells drilled prior to February 15, 1983 shall be located at least 100 feet from any structure provided that the well head is protected from damage and that any building within 300 feet of the well shall be so designed as to provide a minimum three hour fire resistance rating for the wall or walls facing the well head.
   (b)    The well head and storage tanks shall be securely fenced and a gravel surface provided within the fenced area and for a distance of ten feet in all directions outside of the fence. The fence shall be of non-combustible material and shall have a locked gate. No structure shall be located within 30 feet of said fence. A twelve foot wide access road capable of supporting 18 tons and of all weather composition shall be provided to the well head.
   (c)    A construction deposit in the amount of $2,500.00 shall be deposited in cash with the City prior to the start of any work on the site. Said deposit shall ensure restoration of the site after drilling and may be released by the Director of Planning upon determination of compliance.
   (d)    The driller or producer shall submit to the Director of Planning prior to commencing drilling operations evidence of a comprehensive liability insurance policy in the amount of $3,000,000.00. The terms of said policy shall provide for continuous coverage against both bodily injury and property damage until all drilling and construction has been completed and shall be subject to the approval of the Director of Planning.
   (e)    All tanks and equipment shall be located a minimum of 100 feet from any property line.
