723.09 ISSUANCE OF MASSEUR OR MASSEUSE REGISTRATION; EFFECTIVE PERIOD.
   (a)    The Director of Planning may issue a masseur or masseuse registration within twenty-one days following application unless he finds that the applicant for the registration has been convicted within the last five years of a felony; an offense involving sexual misconduct with children; keeping or residing in a house of ill fame; solicitation of a lewd or unlawful act; prostitution; pandering.
   (b)    Upon application, a representative of the City shall provide to the applicant a copy of this Chapter and all the necessary information and forms concerning masseur or masseuse and obtain a signed acknowledgment from the applicant acknowledging receipt thereof.
   (c)    Upon application, the City of Mentor shall have an investigation conducted on the information contained on the application and shall request the appropriate City departments to conduct an inspection of the proposed massage establishment in order to insure that it complies with the requirements of this chapter.
   (d)    Every masseur or masseuse registration issued pursuant to this chapter shall terminate on December 31 following the date of issuance, unless sooner suspended or revoked and shall be renewed annually in December before the first day of January of the next year. No masseur or masseuse shall be required to discontinue performing massages because of the failure of the City to act on a renewal application filed in a timely manner and pending before the City on the expiration date of the person's license.
   (e)    If the application is denied, the applicant shall have the right to appeal to the Board as referred to and in conformity with the procedure outlined in Section 723.06(c). The applicant shall within ten days after notification of denial file notice in writing with the Clerk of Council of applicant's intention to appeal to the Board. The Board, after the hearing, may sustain, disapprove or modify such order.
