531.01 DEFINITIONS.
   As used in this chapter:
    (a)    "Audible" means any sound that can be heard by a person of ordinary hearing using their normal hearing faculties not enhanced by any mechanical device, except for hearing aids worn by a hearing impaired person and which return the wearer to a sense of hearing not greater than that of a person of ordinary hearing. It is not necessary for a sound to be audible within the meaning of this definition that particular words or phrases be identifiable. Further, the detection of a rhythmic bass reverberating type sound is sufficient to constitute an audible sound.
   (b)    "Construction" means any site preparation, assembly, erection, substantial repair, alteration, or similar action.
   (c)    "Demolition" means any dismantling or intentional destruction or removal of structures, utilities, public or private right-of-way surfaces, or similar property.
   (d)    "Dwelling" shall have the same meaning as set forth in Section 1127.01 of the Zoning Code.
   (e)    "Emergency" means any occurrence or set of circumstances involving actual or imminent physical trauma or property damage or loss which demands immediate action.
   (f)    "Emergency work" means any work performed for the purpose of preventing or alleviating the physical trauma or property damage threatened or caused by an emergency.
    (g)   "Intermittent," as used in Sections 531.02(b)(1)(2) and (3), means ceasing at intervals which average five (5) seconds or less in duration within the applicable time periods set forth in said sections.
      “Intermittent," as used in Section 531.02(b)(5), means ceasing at intervals which average one (1) minute or less in duration within the applicable time period set forth in said section.
   (h)    "Lot" shall have the same meaning as set forth in Section 1127.01 of the Zoning Code.
    (i)    "Modified exhaust system" means an exhaust system in which the original noise abatement devices have been physically altered causing them to be less effective in reducing noise or the original noise abatement devices have either been removed or replaced by noise abatement devices which are not as effective in reducing noise as the original devices, or devices have been added to the original noise abatement devices such that noise levels are increased.
   (j)    "Motor vehicle" shall have the same meaning as set forth in Section 301.20 of the Traffic Code.
   (k)    "Person" means any individual, association, partnership, or corporation and includes any officer, employee, department, agency, or instrumentality of a state or any political subdivision of a state.
    (1)    "Point of reception" means any point on a lot where sound originating from a location other than the lot is received.
    (m)    "Sound" means an oscillation in pressure, particle displacement, particle velocity, or other physical parameter, including vibration, in a medium with internal or interval forces that cause compression and rarefaction of that medium, and which propagates at finite speed to distant points. The description of sound may include any characteristic of such sound, including duration, intensity, and frequency.
   (n)    "Sound amplification system" means any radio, tape player, compact disc, loudspeaker, speaker or other electronic device, including portable devices, used for the amplification of musical instruments or other sounds.
