9-1-18: AWNINGS OVER STREETS OR SIDEWALKS:
   A.   Compliance With Provisions: No person shall erect, repair or maintain any awning over any sidewalk or street within the city contrary to any of the provisions of this section.
   B.   Permit Required: No person shall erect any awning over the sidewalk or street without first obtaining from the building inspector or his authorized agent a permit therefor.
   C.   Construction Materials; Clearance: Any awning hereafter erected over any sidewalk or street within the city shall be constructed of adjustable iron frame, firmly secured in place and covered with canvas or other suitable material, and the frame shall be at least seven and one-half feet (71/2') in height above the highest point of the walk; and the lowest point of flap or fringe of such awning shall at no point be less than seven feet (7') above the sidewalk immediately beneath it.
   D.   Metal Or Plastic Awnings; Clearance: Permanent metal or plastic type awnings may be erected; provided, that a minimum clearance of seven and one-half feet (71/2') is allowed from the sidewalk to the lowest part of the awning.
   E.   Categories: The term "awning" shall designate those awnings extending over public property, and shall be divided into two (2) categories:
      1.   "Fixed awnings" means that type of hood or covering over doors and windows constructed of light metals or plastics mounted on frames which are not adjustable or movable.
      2.   "Adjustable awnings" means that type of hood or covering over doors and windows constructed of light metals, plastic, fabric or equivalent material mounted on frames which are adjustable and movable.
   F.   View Of Underside Of Awning: No awning shall be completely or partially enclosed at the bottom thereof, and no wires, cables or pipes under or in the awning that carry heat, water or electricity shall be concealed; provided, however, that the fire chief or his designated subordinate may grant an exception therefrom prior to the issuance of the permit if there is no impediment to immediate observation of any fire or fire hazard.
