9-1-15: MOVING OF BUILDINGS:
   A.   Permit Required: No person, firm or corporation shall move any building or part of any building in, along or across any public street or public ground in the city without first obtaining a written permit therefor. Application for said permit shall be made in writing to the building inspector on forms provided by the building inspector's office. The application for a moving permit may be approved by the building inspector subject to compliance with the following requirements:
      1.   The applicant shall give a bond in the sum of ten thousand dollars ($10,000.00) with one or more sureties as may be approved by the building inspector or his authorized agent conditioned that the applicant will, in carrying out the purpose of the moving permit, conform to all regulations relating thereto; and that applicant will promptly repair and make good to the satisfaction of the street superintendent any and all damages to any public property done or caused by applicant, agents or employees in moving any building or in connection with the moving thereof; and that the applicant will indemnify and keep harmless the city against all liabilities for damages, costs or expenses arising out of any negligence or misconduct on the part of the applicant or his agents or employees in connection with the moving of any building or the use of any public property for that purpose. The building inspector may waive the posting of bond for buildings five hundred (500) square feet or less.
      2.   The applicant shall file a copy of the notice served upon the owners of wires suspended above streets and public properties showing that payment of the expense of adjusting and repairing said wires in connection with moving the building or buildings will be paid by the applicant.
      3.   Every permit to move a building shall state all conditions to be complied with, designate the route to be taken and limit the time for removal and shall have the approval of the building inspector. The progress in removal of a building shall be as continuous as possible during all hours of the day and night, if the building inspector or his authorized agent so orders, until complete, with the least possible obstruction to thoroughfares. No building shall be allowed to remain overnight upon any street crossing or intersection, or so near thereto as to prevent any easy access to any fire hydrant, or within twenty feet (20') of the property line of the intersecting street extended. Distinctive lights shall be kept in conspicuous places at each elevation of the building during the night.
      4.   Permission shall in no case be granted to move a building in, along or upon the public streets of the city until such buildings shall have been measured by the mover and it shall appear from such measurement that the moving of the building in, upon or along the streets proposed will not injure any shade trees along such streets.
      5.   Trees or shrubs shall not be trimmed or otherwise disturbed without the approval of the city and the property owner.
      6.   The building inspector shall immediately notify the chiefs of the fire department and the police department and the superintendent of streets of the issuance of a permit to move a building by means of filing a copy of said permit with these officers. The building inspector shall secure the advice of the street superintendent and chiefs of the fire and police departments as to the suitability of proposed time and route of the movement of the building. Factors of public safety shall determine the conditions of the permit.
      7.   Nothing in this permit shall be construed as authorizing the permit holder to damage, injure or destroy any public or private property without permission from the owner or owners thereof.
      8.   The building inspector along with the superintendent of streets shall, immediately after any building permitted to be moved by this section has been moved to its destination, inspect all streets and public properties over which said building has moved and ascertain the condition of the same. If any damage has been caused to any property by the movement of the permitted structure, a report shall be filed in the office of the building inspector who shall require payment to the city of the expense of making the necessary repairs in accordance with the permit and bond accompanying the same.
   B.   Dilapidated Buildings: No permit shall be granted for the moving of any building from one location to another which, in the judgment of the building inspector or his authorized agent, is so dilapidated and so out of repair as to be unsanitary, unfit for human habitation, occupancy or use, or which is so out of repair that it would be unreasonable to repair the same.
   C.   Violation: Every day of violation shall be considered as a separate offense. (1975 Code Ch. 16 § XV)
