9-1-2: DEFINITIONS:
ACCESSORY BUILDING: A subordinate building not a part of the main building, the use of which is incidental to that part of the main building or to the use of the premises.
ACCESSORY USE: A use incidental to the use of the main building or to the principal use of the premises.
ALLEY: A public thoroughfare which affords only a secondary means of access to abutting property, and is less than twenty one feet (21') wide.
ALTERATIONS: Any change, addition or modification in construction.
APPROVED AS TO MATERIALS AND TYPES OF CONSTRUCTION: All materials and types of construction approved in the Wisconsin uniform dwelling code and the Wisconsin commercial building code.
BUILDING: Any structure designed or intended for the support, enclosure, shelter or protection of persons, animals or property. When a structure is divided into separate parts or unpierced walls extending from the ground up, each part is deemed a separate building.
GARAGE, COMMUNITY: A space or structure, or a series of structures for the storage only of noncommercial vehicles of residents of the neighborhood.
GARAGE, PRIVATE: A space in a building or attached thereto or a structure on the same lot with the building to which it is accessory, used primarily for the storage only of vehicles by persons residing on the premises, except that as many spaces therein as there are families residing on said premises may be used by persons not resident on said lot for the storage of an equivalent number of noncommercial vehicles. A resident on said premises may store one and one only commercial vehicle, which vehicle may not exceed two (2) ton capacity.
GARAGE, PUBLIC: A space or structure other than a private or community garage, for the storage, sale, hire or repair of motor vehicles, or vehicles used in connection therewith.
IMPERVIOUS TO WATER: Construction of concrete, cement block, terrazzo, brick tile or other material approved by the building inspector or his authorized agent, and having tightfitting joints, and not having more than four and one-half percent (41/2%) absorption by test.
OCCUPANT: The person who is the responsible head of a family or individual or individuals residing in a dwelling.
OWNER: Every person, firm, partnership or any individual member thereof, corporation, business organization of any kind, the state, the county, the city, any sewer district, drainage district, the University of Wisconsin extension center, and any corporation or organization having an interest in property of any kind, and shall include the representative, officer, agent or any person having the ownership, control, custody or management of any building.
START OF CONSTRUCTION: Either the first placement of permanent construction on a site such as the pouring of a slab or footings, the installation of piles, the construction of columns, or any work beyond initial excavation, or the placement of a manufactured home on a foundation. Permanent construction does not include land preparation, such as clearing, grading and filling, nor does it include the installation of streets or walkways, nor does it include excavation for a basement, footings, piers or foundations or the erection of temporary forms. For an alteration, the start of construction means the first alteration of any wall, ceiling, floor or other structural part of a building, whether or not that alteration affects the external dimensions of the building.
STREET: A public or private right of way, lane or way set aside permanently for common travel and being twenty one feet (21') or more in width if it existed on October 1, 1967, and being forty feet (40') or more in width if it came into existence after October 1, 1967.
STRUCTURAL ALTERATIONS: Any change in the supporting members of a building, such as bearing walls, columns, beams or girders, excepting such alterations as may be required for the safety of the building.
STRUCTURE: Anything constructed, erected, or placed, the use of which requires location on the ground, or attached to something having a permanent location on the ground.
YARD: An open unoccupied space on the same lot, with a dwelling, and lying between the front, rear or sides of the dwelling and the lot line. (1975 Code Ch. 16 § II; amd. Ord. 2007-06, 7-2-2007)
