8-2-4-2: USERS:
   A.   It shall be unlawful for any person to place, deposit or permit to be deposited any sewage on the ground surface of any public or private property or in any natural outlet within the jurisdiction of the utility.
   B.   Except as provided for in this section, it shall be unlawful to construct or maintain any privy, privy vault, septic tank, cesspool or other facility intended or used for the disposal of sewage.
   C.   The owner of all houses, buildings or properties for human occupancy, employment, recreation or other purposes, situated within the jurisdiction of the utility and abutting on any street, alley or right of way in which there is located a sewer system is hereby required at his expense to install suitable sanitary sewer facilities therein and to connect such facilities directly to the sewer system that is available for connection in accordance with the provisions of this chapter within ninety (90) days after date of official notice by the superintendent or his designee to do so. In the event that an owner has in place a private sewage system at the time that a sewer system becomes available for connection, this requirement need not be complied with until the occurrence of the first of the following to occur:
      1.   Transfer of the property by deed or land contract; or (1975 Code Ch. 5 § II)
      2.   In the event that the state of Wisconsin department of commerce or the Dunn County zoning administrator determines that the private sewer system is failing or malfunctioning. (1975 Code Ch. 5 § II; amd. 2009 Code)
   D.   With respect to subsection C1 of this section, the owner shall notify the superintendent in writing, within ten (10) days of the date of the transfer of ownership of the property as to the transfer, the date of transfer and the name(s) and address(es) of the new owners. The superintendent shall give official notice to the new owner that the new owner shall, within thirty (30) days, install at his expense suitable sanitary sewer facilities therein and to connect such facilities directly with the sewer system in accordance with the provisions of this chapter.
   E.   With respect to subsection C2 of this section, in the event that it is determined that the private sewage system is failing or malfunctioning, the superintendent shall give official notice to the owner that the owner shall, within thirty (30) days, install at his expense suitable sanitary sewer facilities therein and to connect such facilities directly with the sewer system in accordance with the provisions of this chapter.
