7-4-2: USE OF AMPLIFYING EQUIPMENT:
   A.   Definitions:
    PERSON: Shall include any person, firm, corporation, association, club, partnership, society or any other form of association or organization.
   SOUND AMPLIFYING EQUIPMENT: Any machine or device for the amplification of the human voice, music or any other sound. "Sound amplification equipment" shall not be construed as including standard automobile radios when used and heard only by occupants of the vehicle in which installed or warning devices on authorized emergency vehicles or horns or other warning devices on other vehicles used only for traffic safety purposes, nor shall it be construed as including standard radio receiving sets.
   B.   Use Of Sound Amplifying Equipment:
      1.   Registration Required: No person shall use, or cause to be used, sound amplifying equipment within any city park in the city, before filing a registration statement with the city clerk in writing and receiving a permit therefor. This registration statement shall be filed in triplicate and shall state the following:
         a.   Name and home address of applicant.
         b.   Address of place of business of applicant.
         c.   Name and address of person who owns the sound amplifying equipment.
         d.   Name and address of person having direct charge of the sound amplifying equipment.
         e.   Names and addresses of all persons who will use or operate the sound amplifying equipment.
         f.   The purpose for which the sound amplifying equipment will be used.
         g.   A statement as to the city park and the area within the park where the sound amplification equipment will be used.
         h.   The proposed days and hours of operation of the sound amplifying equipment.
         i.   A general description of the sound amplifying equipment which is to be used.
         j.   An agreement to comply with the following restriction at all times: The sound pressure level shall not exceed ninety five (95) dB, at a distance of thirty five (35) meters from the source, using the "A" weighting level.
      2.   Registration And Identification: The city clerk shall return to each applicant one copy of said registration statement duly certified by the city clerk as a correct copy of said application and shall issue a permit therefor. A copy of the application and permit shall be forwarded by the city clerk to the chief of police. Said certified copy of the application and permit shall be in the possession of any person operating the sound amplifying equipment at all times while the sound amplifying equipment is in operation, and said copy shall be properly displayed and shown to any police officer or other city official upon request.
      3.   Regulations For Use: Use of sound amplifying equipment in the city shall be subject to the following regulations:
         a.   The only sounds permitted are music or human speech.
         b.   Operations are permitted only from no earlier than ten o'clock (10:00) A.M. to no later than ten o'clock (10:00) P.M. on each day, in the city park and at a location to be designated by the city clerk.
      4.   Permit Fee: A sound amplifying equipment permit fee of ten dollars ($10.00) shall accompany the registration application for each day of operation of the sound amplifying equipment.
   C.   Operating Without Permit: No person shall operate any sound amplifying equipment in any city park without a permit or in violation of the terms of the permit.
   D.   Violation: Each and every violation of the provisions of this section shall constitute a separate offense, and each and every day any provision of this section is violated shall constitute a separate offense. (1975 Code Ch. 10 § IV)
