A. Supervision: The Park-Recreation Director and Park Supervisor shall have the supervision of all parks and park property, including the enforcement of ordinances relating to parks and the enforcement of any rules relating to the use of parks.
B. Commercial Activity Restricted; Permit: No person, organization or corporation shall use park property for advertising, soliciting, peddling, selling or otherwise promoting a commercial activity, except that the Park-Recreation Director or Park Supervisor may grant permits for the use of park property to place temporary stands, booths or other facilities used for the sale of food products or display of commodities when such concessions are in conjunction with permitted programs or activities, which use shall be limited to a period not to exceed three (3) days; and except that the Recreation Advisory Board may grant permission to any person, organization or corporation to advertise products and/or activities of such kind or nature and for such a period of time as it in its discretion deems proper.
C. Pollution Of Park Waters: No person shall throw, discharge or otherwise place or cause to be placed in the waters of any lake or stream or other body of water in or adjacent to any park, any substance, matter or thing, liquid or solid, which will or may result in the pollution of said waters.
D. Dumping Of Trash: No person shall bring garbage, waste, rubbish, ashes, paper, boxes, cans, bottles, dirt, or other refuse or trash, hereinafter referred to as "refuse", into a City park for the purpose of depositing, dumping or leaving same, whether refuse is placed in a City trash receptacle or not. If refuse is generated in a City park, none shall be dumped, deposited or left anywhere on the grounds thereof, but shall be placed in the proper receptacles where they are provided; where receptacles are not provided, all such refuse shall be carried away from the park by the person responsible for its presence, and properly disposed of elsewhere.
E. Plants And Grass Protected:
1. No person shall in any manner injure or destroy any tree, shrub, building or property of any kind in any of said parks.
2. No person shall dump salt water or ice on the grass.
F. Fires: No person shall start, tend or maintain a fire except in personal grills or fireplaces. The use of personal grills is permitted provided lawns and vegetation are not endangered. Unburned fuel and ashes shall be disposed of in such a manner as to prevent fire or damage to any park property. (1975 Code Ch. 8 § I)
G. Animals:
1. Allowed In City Parks: Dogs and other domesticated animals are allowed in any City park. While in such City park it shall be the duty of every owner/custodian of any animal or anyone having any animal in their possession or custody to:
a. Exercise reasonable care and to take all necessary steps and precautions to protect other people, property and animals from injuries or damage which might result from their animal's behavior, regardless of whether such behavior is motivated by mischievousness, playfulness, ferocity or viciousness.
b. Ensure that the animal is kept under reasonable restraint. No person shall bring any unleashed pet into any such City park. Said leash shall be no longer than eight feet (8'). Control by means of radio collar is strictly prohibited.
c. Promptly remove and dispose in a sanitary manner any excreta deposited by such animal.
d. Ensure that all animals are licensed and tagged appropriately.
e. Ensure that no animals go within twenty feet (20') of any established playground area, athletic field, tennis and pickleball court, or waterpark.
2. Animals In Water: No person shall allow their dog or other domesticated animal in the water in any swimming beach, excepting dogs may be allowed in the water at beaches during the holding of any sportsmen's dog contest.
3. Public And Private Events In City Parks: Dogs or other domesticated animals may be allowed at public or private events within a City park as authorized by the Parks and Recreation Director or their designee or as authorized at the discretion of the private event sponsor. Private event sponsors are responsible for posting signage giving notice whether or not animals are permitted at such private event. (Ord. 2018-04, 4-2-2018)
H. Motor Vehicle Speed: No person shall operate a motor vehicle within the limits of any park at a speed in excess of fifteen (15) miles per hour except as noted in subsection 6-3-1B of this Code. No person shall drive upon or park any motor vehicle in any City park except: 1) on the roadways; 2) upon those places designated for parking purposes; or 3) with the consent of the person in charge of the park or some police officer or person directing traffic.
I. Hours: All parks in the city shall be closed to the public between the hours of ten o'clock (10:00) P.M. through seven o'clock (7:00) A.M. No person or persons shall enter or attempt to enter a park during closing hours unless and excepting they are under the immediate supervision of the park-recreation director or park supervisor. The common council may alter the times during which one or more parks are closed on specified dates and establish conditions of park use during said altered times.
J. Hunting In Parks: No person shall shoot at, wound, kill, take, capture, ensnare, net or trap or in any manner molest or injure any animal or bird in any city park, except as permitted in subsection 5-1-3B2c of this code.
K. Specified Uses: The park-recreation director or park supervisor shall prescribe which park areas may be used for specified purposes or which park areas are restricted from use through the use of signs or other means of public notice. No person or persons may use such designated park areas contrary to purposes specified by the park-recreation director or park supervisor.
L. Organized Activities: The park-recreation director or recreation supervisor shall have the authority to reserve areas of the parks for use by recreation department programs or other organized activities to gain the best use of park facilities for the city.
M. Storage Of Boat Or Ice Fishing House: No person shall park or store any boat or ice fishing house in the city parks or shorelines fronting on city property excepting that boats may be moored at regular boat landing areas for a period not exceeding twelve (12) hours. The park-recreation director or park supervisor may remove any boat or ice fishing house that is stored or parked in violation of this subsection and may impound such property. The park-recreation director or park supervisor shall cause notice to be published in the official newspaper which notice shall give a description of the boat or fishing house and shall specify that in the event said boat or fishing house is not claimed within a period of forty eight (48) hours from date of publication and payment of a fee in the amount of twenty five dollars ($25.00) for impounding said property and the fee for publication of notice, said property will be disposed of.
N. Mooring: No watercraft shall be moored to a boat launching dock for more than ten (10) minutes.
O. Water Skiing: There shall be no water skiing from any boat launching dock when posted with a sign by the park-recreation director or park supervisor prohibiting said use. (1975 Code Ch. 8 § I)
P. Rates, Rules, Regulations Established: Notwithstanding the requirements of subsection A of this section, the common council, by resolution, shall establish rates, rules and regulations for the Wakanda waterpark and the dog park. (Ord. 2009-02, 7-6-2009)
Q. Alcoholic Beverages: No alcoholic beverages shall be allowed in Fowler park. (Ord. 2006-19, 9-18-2006)
