6-4-11: PARKING METERS:
   A.   Installation And Use:
      1.   Metering And Use: All streets or part or parts thereof now metered are hereby approved and confirmed. Additional streets or parts of any street or streets or Municipal parking lots may be metered as shall hereinafter be designated by the Parking Utility Commission. The Police Department shall have charge of the regulation thereof.
      2.   Placement: The meters shall be placed upon the curb next to the individual parking places and they shall be so constructed as to display a signal showing legal parking upon deposit therein of proper payment indicated by instructions on the meters or parking meter kiosks.
      3.   Charges: The charge for parking in parking meter areas on City streets shall be:
         a.   Fifty cents ($0.50) per hour for all meters which are solely coin operated; and
         b.   One dollar ($1.00) per hour for all credit card enabled electronic meters, including parking meter kiosks.
       4.   Unlawfully Parked Vehicles; Exception:
         a.   Whenever any vehicle shall be parked next to a parking meter, the operator of the vehicle shall park within the area designated by the curb and street marking lines as indicated for parallel and diagonal parking, and upon entering the parking space shall immediately deposit in the meter the coin required to activate the meter. It shall be unlawful for any person to fail or neglect to deposit such coin or to fail to park within the area limits designated. Such parking space may then be used by such vehicle during the time limited herein according to the sum thus deposited, and such vehicle shall be unlawfully parked if it shall remain in such space beyond the period of time for which the operator shall have deposited such coin in the meter. It shall be unlawful for any person to cause any vehicle to be unlawfully parked as provided in this subsection.
         b.   This shall not apply to the vehicles of City officials conducting official business when said vehicles are displaying an "official business" permit issued by the Mayor nor to City owned vehicles when engaged in official business.
         c.   This restriction shall not apply to vehicles engaged in providing services of construction, installation, maintenance or repair to properties in the metered area of the City, provided the following conditions are met:
            (1)   The meter for the space used is activated to its full time limit or one hour, whichever is less.
            (2)   A valid permit is displayed in the right windshield of the vehicle. Said permit shall be obtained from the City Treasurer-Comptroller for an annual fee of eighty dollars ($80.00), which may be prorated to twenty dollars ($20.00) quarterly.
            (3)   The service being provided must be to a property other than that of the permit holder.
      5.   Injuring Meters: It shall be unlawful and an offense for any person to deface, injure, tamper with, open, break, destroy or impair the usefulness of any parking meter installed under the terms of this section.
      6.   Use Of Slugs In Meters: It shall be unlawful and an offense to deposit or cause to be deposited in any parking meter any slug, device or metallic substitute for a United States coin.
      7.   Collection Of Monies: The Treasurer-Comptroller of the City shall collect or cause to be collected the monies deposited in the meters.
      8.   Disposition Of Funds: The money collected from parking meters shall be used by the Parking Utility Commission to pay for collection of parking meter funds, for repair, maintenance, replacement and acquisition of new meters and for the purchase, construction, maintenance and operation of Municipally owned off street parking lots.
   B.   Enforcement:
      1.   Issuance Of Ticket: It shall be the duty of the Police Department to take the parking meter number and State vehicle number or other identification of all vehicles whose operators violate the provisions of this section and to cause notice thereof to be written in duplicate, leaving one copy with the operator or his/her vehicle, and the other with the Police Department.
      2.   Continued Violation: In addition to an initial violation of this chapter, each period of time which is equal to and in excess of the prescribed parking meter time limit, or two (2) hours, whichever is less, during which a vehicle remains in violation shall constitute a separate violation of this provision.
      3.   Payment Of Forfeitures:
         a.   Any person violating subsection A3 or A4 of this section shall pay a forfeiture in accordance with section 1-4-6 of this Code, by leaving the amount thereof with the Police Department to be turned over to the City Treasurer-Comptroller and shall be paid within forty eight (48) hours after the time of delivery of the citation as indicated by the arresting officer therein.
         b.   Any person violating subsection A5 or A6 of this section shall pay a forfeiture in accordance with section 1-4-6 of this Code. (1975 Code Ch. 7 § VI; amd. 2009 Code; Ord. 2017-03, 5-1-2017; Ord. 2019-09, 5-20-2019; Ord. 2022-05, 8-15-2022)
